Terms and Conditions

My Tulsi Nutrition — Klaudia Burian, NBC-HWC (mytulsinutrition.com)

These Terms & Conditions (“Terms”) govern your use of mytulsinutrition.com (the “Site”) and any coaching session, program, or group series you purchase from My Tulsi Nutrition, operated by Klaudia Burian, NBC-HWC (“Coach,” “we,” “us”). By using the Site, booking a session, or enrolling in a program, you (“Client,” “you”) agree to these Terms. If you enrolled in a specific program under a separate signed agreement, that agreement’s specific terms (e.g., session count, program fee, and dates) control over this general document where the two conflict.


1. The Services

My Tulsi Nutrition offers functional and integrative nutrition and health coaching, including individual (1:1) coaching sessions and health-history reviews, and group educational programs (such as Rocking the Pause). Specifics for a given program — session count, length, price, and dates — are set out at enrollment/checkout or in a signed program agreement.


2. Eligibility

You must be at least 18 years old to purchase or participate in the Services. By enrolling, you confirm you meet this requirement and that the information you provide is accurate.


3. Scheduling, Cancellation & Rescheduling

  • Sessions begin and end at their scheduled time (e.g., a “50-minute session” ends 50 minutes after its start), out of respect for every client’s schedule.
  • If you need to cancel or reschedule a 1:1 session, you must give at least 24 hours’ notice. Sessions cancelled with less notice are forfeited and cannot be rescheduled.
  • Rescheduled sessions must be completed within the timeframe stated in your program agreement (typically within 2 months of the program’s stated end date).
  • A program expires if its sessions are not completed within the timeframe stated in your program agreement.
  • Group programs (e.g., a 12-week series) run on the published schedule; missed live sessions may be covered by replay where a Group Program Confidentiality & Recording Disclaimer applies.


4. Program Fees, Payment & Refunds

Fees for a given program are stated at checkout or in your signed program agreement, and payment is due at or before your first session unless otherwise agreed in writing. Accepted payment methods are shown at checkout.

If you withdraw or are absent for any reason once a program has begun, you remain responsible for the pro-rata share of the program already delivered, plus a $50 cancellation fee. If the Coach determines, in her judgment, that continuing is not advantageous for the coaching relationship, she may end the program early; in that case, you are responsible only for the pro-rata share of services already received.

Confirm current refund wording matches whatever is configured at checkout (e.g., in Stripe) before publishing, so the two never say different things.


5. Coaching Disclaimer — Not Medical Advice

The Coach is a National Board Certified Health & Wellness Coach (NBC-HWC), not a physician, licensed dietitian-nutritionist, psychologist, or other licensed or registered healthcare professional. Coaching is not medical or nutrition therapy and does not diagnose, treat, or cure any disease or condition. The Coach’s role is to mentor and guide you, using holistic health coaching skills, toward sustainable lifestyle changes you choose for yourself. Nothing said in a session, program, or on the Site replaces the advice of your doctor or other licensed professional. If you are under the care of a healthcare provider or take prescription medication, discuss any dietary or lifestyle changes with your provider before making them, and do not stop any prescribed medication without first consulting your provider.


6. Personal Responsibility & Release of Claims

You acknowledge that you are solely responsible for your own life, health, and well-being (and, where applicable, that of your family), and for all decisions you make during and after working with Coach. You knowingly and voluntarily assume the risks of coaching, including the risks of trying new foods, supplements, or lifestyle changes discussed. To the fullest extent permitted by law, you release Coach from any and all liability, claims, damages, or causes of action arising from your participation in the Services, except for claims arising from Coach’s gross negligence.


7. Confidentiality

The Coach keeps information you share in 1:1 sessions private and will not disclose it to any third party except as required by law. Group programs involve additional confidentiality obligations — both from the Coach and from fellow participants — and are governed by the separate Group Program Confidentiality & Recording Disclaimer provided at enrollment in any group program.


8. Intellectual Property

All program materials, worksheets, session replays, and Site content are the property of My Tulsi Nutrition / Klaudia Burian and are provided for your personal, non-commercial use only. You may not copy, distribute, resell, or publicly share these materials without our prior written consent.


9. Site Use

You agree to use the Site lawfully and not to interfere with its operation, attempt unauthorized access, or misuse any content found on it. We may update, suspend, or discontinue any part of the Site at any time.


10. Third-Party Services & Links

The Site and checkout process may link to or rely on third-party services (for example, our payment processor or scheduling tool). We are not responsible for the content, policies, or practices of third-party sites or services.


11. Limitation of Liability

To the fullest extent permitted by law, My Tulsi Nutrition and Klaudia Burian will not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or the Services. Our total liability for any claim relating to the Services is limited to the amount you paid for the program giving rise to the claim.


12. Dispute Resolution: Arbitration & Choice of Law

Any dispute arising from these Terms, a program agreement, or the coaching relationship will be resolved by binding arbitration before the American Arbitration Association (Commercial Arbitration and Mediation Center for the Americas Mediation and Arbitration Rules), before a single arbitrator, with judgment on the award enforceable in any court of competent jurisdiction. The sole remedy available to Client in arbitration is a refund of the program fee; no award of consequential or other damages will be made beyond what is expressly provided here. These Terms are governed by the laws of the State of Illinois. If any provision is found unenforceable, the remaining provisions remain in full force.


13. Changes to These Terms

We may update these Terms from time to time; the “Effective Date” above reflects the latest revision. Continued use of the Site or Services after an update means you accept the revised Terms. Where you’ve signed a separate program agreement, its specific terms continue to control for that program.

Group Program Confidentiality Disclaimer

Group Program Confidentiality & Recording Disclaimer

This disclaimer applies whenever you join a group coaching or education program with MyTulsi Nutrition (a “Group Program”), whether live, by video call, or through session replays. It supplements — and doesn’t replace — the general Terms & Conditions and Privacy Policy, which continue to apply. 


1. Confidentiality Between Participants

A Group Program is a shared space. Other participants may share personal health information, experiences, or struggles as part of group discussion. By joining, you agree to keep private whatever is shared by other participants in the group — you will not repeat, screenshot, record independently, or discuss outside the group anything another participant shares, including their identity, without that person’s permission.

The Coach will likewise keep what you personally share with her privately (e.g., in intake forms or 1:1 follow-up) confidential, and will not disclose it to other participants or any third party except as required by law, consistent with the Terms & Conditions.

Because this is a group format, the Coach cannot guarantee that every participant will honor this agreement, and cannot be held responsible for another participant’s breach of confidentiality — only for her own.


2. Recording of Sessions

Live sessions in a Group Program may be recorded (audio and/or video) so that enrolled participants who miss a live session can access a replay, and so the Coach can maintain program records. By enrolling in and attending a Group Program, you consent to being recorded as part of the group session.

  • If you do not wish to appear on camera, you’re welcome to join with your camera off and use a name/initial you’re comfortable being visible in the recording. *Prior notification of screen name change must be provided to be let into the class using a different name than the one provided in the original registration.*
  • If you do not wish your voice to be recorded, please keep your microphone muted and use the chat feature to participate instead, or let the Coach know in advance so alternate arrangements can be discussed.
  • Each live session will include a spoken and/or on-screen notice at the start that recording is in progress.

Illinois law (the Illinois Eavesdropping Act, 720 ILCS 5/14) generally requires the consent of all parties to a recorded private conversation. This section, together with the affirmative notice given at the start of each session, is intended to provide that consent for participants who choose to remain in the session after the recording notice; a participant who does not consent should follow the camera-off/mute options above or contact the Coach directly.


3. How Recordings Are Used & Stored

  • Recordings and replays are made available only to participants enrolled in that specific Group Program, through a private link or platform — they are not published publicly.
  • Recordings are retained for as long as reasonably needed to provide replays for the current run of the program, after which they are deleted or archived privately.
  • Recordings will not be used in marketing, testimonials, or shared outside the enrolled group without separate written permission from anyone identifiable in the clip.


4. Educational Content, Not Medical Advice

Group Program content is educational and general in nature — it is not individualized medical or nutrition therapy advice, diagnosis, or treatment, and is not a substitute for care from your doctor or other licensed healthcare provider. 5. Acknowledgment

By registering for and attending a Group Program, you acknowledge that you have read and agree to this Group Program Confidentiality & Recording Disclaimer, in addition to the Terms & Conditions and Privacy Policy.
